This Privacy Policy explains the process by which JENRES collects, uses and protects personal information that users provide while using our services.
1. INFORMATION COLLECTION

In the use of the service, JENRES collects personal information. Such information may include, but is not limited to:
  • Account Details: username, name, email address with read-only access.
  • Organization details: organization name, members with read-only access, team discussions with read and write access.
  • Repository Details: contents with read and write access, discussions with read and write access, issues with read and write access, metadata with read only access, pull requests with read and write access.
  • Feedback: any info you provide through surveys, reviews, or interactive features.
  • Payment Info: if you're on a paid plan, we'll need your name, billing address, and payment details. 
  • Sales and Marketing: this covers details we use for promotions, like your name, email, and company.   
2. PURPOSE OF TREATMENT

JENRES uses the personal information collected for the following purposes:
  • to pursue the main objectives of the Service;
  • to provide and administer the services, including purchasing, payment, back-up and customer support;
  • to personalize and improve your experience with the services;
  • to communicate with you regarding the services, special offers, updates and promotions;
  • to monitor usage of the services and analyze trends to improve performance and security; and
  • to comply with applicable laws.
In carrying out these activities, JENRES practices data minimization and uses the minimum amount of    personal information required.
We’ll retain your Personal Data as long as your account is active and as needed to fulfill any contractual obligations.
You are entitled to request us to delete any Personal Data, barring a few exceptions such as circumstances where we are required to retain data to comply with legal obligations, detect fraudulent activity, investigate reports of abuse or other violations of our Terms and Conditions of Service or for security issues.
We will do our best to respond promptly to your request.
We may retain certain data as necessary for legal obligations or for establishing, exercising, or defending legal claims.
 
3. INFORMATION SHARING 

We will not share your personal information with any third party outside of JENRES except as follows:
  • when necessary to provide the services requested by the user;
  • with the express consent of the user;
  • to respect applicable laws or protect our legal rights.
We may disclose personal data in good faith if necessary to prevent fraud, abuse, or attacks on our services or to protect the security of JENRES and our users.
Personal data may be shared with JENRES affiliates to facilitate the pursue of the main objective of the Service, customer service, marketing, advertising, order processing, billing, technical support, and legal and compliance obligations. Our affiliates may only use personal data in accordance with this Privacy Policy.
We may disclose personal data to authorized law enforcement entities, regulators, courts, or other public authorities in response to legitimate requests or to protect our rights and security. In accordance to the Terms and Conditions, we recognize and cooperate with law enforcement entities of: Italy, the residence territory of the user, the territory from which the user is operating.
We may disclose personal data within the limits of the law and in accordance with this Privacy Policy for strategic business transactions such as sales or mergers.
We cooperate with third parties offering sales, consultancy, support, and technical services for our services. We may share your data with these partners and resellers where permitted and with your consent when required.
We may use providers to deliver services on our behalf, including hosting, marketing, advertising, social, analytics, ticketing support, credit card processing, or security services. 4. ACCESS TO REPOSITORIES

When JENRES accesses any repository, the original owner will maintain property and control over any of the information contained in said repository. JENRES staff do not access private information without consent, except as provided in this Privacy Policy and for:
  • pursuing the main objectives of the Service;
  • back-up purposes;
  • security purposes;
  • automated scanning or manual review for known vulnerabilities, active malware, or other content known to violate our terms of service;
  • assisting the repository owner with a support issue;
  • maintaining the integrity of the services, or;
  • complying with our legal obligations if we have reason to believe the content violates the law
Upon request, JENRES will provide you with notice of access to the private collection unless prohibited by law or if JENRES has acted in response to a security threat or other security risks.
 
5. SECURITY OF INFORMATION

We take appropriate security measures to protect personal information from loss, misuse, unauthorized access or disclosure. However, any method of transmission across the Internet or electronic storage is not completely secure, and therefore we cannot guarantee the absolute security of your information and we will not be liable for any breach of security unreasonably within our control.
The user is responsible for maintaining the confidentiality of his account identifier and password. If the user discovers any unauthorized use of his account, if they loses the login credentials or if they suspects a security breach, it is their responsibility to promptly notify us immediately at the following email address: dpo@res-it.com.
 
6. LEGAL BASE OF THE TREATMENT
 
JENRES processes Personal Data in compliance with the GDPR 2016/679, ensuring a lawful basis for each processing activity. The basis varies depending on the type of data and the context, including how you access the services.
The processing of the user's personal information is governed by this Privacy Policy as well as the Terms and Conditions of JENRES.
The treatment of the user's personal information by JENRES is based on one of the following legal bases: (i) user consent: processing is carried out with the user's consent for one or more specific purposes; (ii) execution of a contract: the processing is necessary for the execution of a contract with the user or for the performance of pre-contractual obligations; (iii) performance of a legal obligation: the processing is necessary to comply with a legal obligation to which JENRES is subject; (iv) legitimate interests: the processing is carried out in the legitimate interest of JENRES or a third party, always respecting the fundamental rights and freedoms of the user.
 
7. USER RIGHTS

You have specific rights regarding the treatment of your personal information by JENRES in accordance with the applicable legal provisions.
You have the right to request and obtain detailed information on what personal data is processed by JENRES and how it is used. You also have the right to request that your data be corrected or updated if they are inaccurate or incomplete.
You have the right to request the deletion of your personal data, within the limits of the applicable law, as well as the restriction of processing in certain circumstances, for example if you dispute the accuracy of the data or if the processing proves to be unlawful. The user also has the right to receive his or her personal data in a structured, commonly used and machine-readable format, and to transmit such data to another data controller where technically possible.
The user may oppose the processing of his or her personal data in certain circumstances, including processing for direct marketing purposes.
8. INFORMATION FOR MINORS
 
Our Services are not intended for minors individuals. We do not intentionally gather Personal Data from such individuals. If you become aware that a minor has provided us with Personal Data, please notify us.

We reserve the right to make changes to this Privacy Policy at any time. Any such changes will be promptly posted on our website, accompanied by an updated revision date. Your continued use of our services following these changes will constitute your acceptance of these changes.
